The prosecution appealed on the 2nd against the first trial verdict메이저사이트 of a 19-year-old man who had sex with a 12-year-old elementary school student he knew through social media (SNS) and gave birth to her.
The Seoul Southern District Prosecutors’ Office said it filed the appeal today, citing sentencing injustice against the first trial court, which sentenced A, a 19-year-old man suspected of raping a minor, to one year and eight months in prison and exempted him from a personal information disclosure notification order and a work restriction order. Earlier, A had also submitted an appeal to the court immediately after the first trial.
“The prosecution took into account the poor quality of the crime in light of the age of the victim, the motive and consequences of the crime, the fact that he was not forgiven by the victim and his family, and the high risk of recidivism in light of the method and course of the crime,” the prosecution said.
According to a report by TV Chosun on the 31st of last month, Ahn was accused of having sex three times over a month with a 12-year-old elementary school student he met through social media in December 2021, causing her to give birth to a child.
“Mr A’s crime is poor in that he committed adultery with a 12-year-old victim at a time when she should have been forming a healthy sexual identity and values,” the first trial court said, adding that the victim had an unwanted pregnancy and childbirth.
Since the incident, the victim and her family have been receiving treatment for mental trauma, and the child she gave birth to was reportedly placed in an adoption agency.
However, the court stated that it took into consideration that “the defendant cooperated with the investigation, admitted to all the facts of the crime, and reflected on his wrongdoing,” as reasons for the sentence.
